Agreement to Terms

By downloading, installing, or using the MUZIM application ("App," "Service," or "MUZIM"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, do not use the App.

Description of Service

MUZIM is a macOS application that provides:

  • Local photo and file management

  • Integration with Google Photos (via Photos Picker API)

  • Integration with Google Drive (read-only access)

  • Local synchronization of selected media and files

  • Photo organization and search capabilities

Eligibility

You must be at least 13 years old to use MUZIM.
By using the App, you represent and warrant that you meet this age requirement.

License and Restrictions

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use MUZIM for personal, non-commercial purposes, subject to these Terms.

Restrictions

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the App

  • Remove or modify any copyright, trademark, or proprietary notices

  • Use the App for any illegal or unauthorized purpose

  • Attempt to gain unauthorized access to any systems or networks

  • Use the App in any way that could damage, disable, or impair the service

  • Share your Google account credentials with others through the App

  • Use the App to violate any applicable laws or regulations

User Accounts and Authentication

Google Account Connection

  • You may connect your Google account to access Google Photos and Google Drive

  • You are responsible for maintaining the security of your Google account

  • You grant MUZIM permission to access only the data you explicitly select

  • You can revoke access at any time through Google’s account settings

Account Security

  • Keep your device and account credentials secure

  • Notify us immediately of any unauthorized access

  • You are responsible for all activities under your account

Data and Privacy

Your Data

  • Your photos and files remain on your local device

  • MUZIM does not upload your data to remote servers (except Google APIs for sync)

  • We do not claim ownership of your content

  • You retain all rights to your photos and files

Google Services

  • Your use of Google Photos and Google Drive is subject to Google’s Terms of Service

  • MUZIM acts as a client to access Google services on your behalf

  • We are not responsible for Google’s services or their availability

Privacy Policy

Your use of MUZIM is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Intellectual Property

Our Rights

  • MUZIM and its original content, features, and functionality are owned by us

  • Our trademarks, logos, and service marks are our property

  • You may not use our intellectual property without prior written consent

Your Content

  • You retain ownership of all content you sync or store using MUZIM

  • You grant us a limited license to process your content locally for service functionality

  • This license terminates when you delete your content or uninstall the App

Third-Party Services

Google APIs

MUZIM uses the following Google services:

  • Google Photos Picker API

  • Google Drive API

  • Google OAuth 2.0

Your use of these services through MUZIM is subject to:

  • Google API Services User Data Policy

  • Google Terms of Service

No Endorsement

We do not endorse and are not responsible for third-party services, their content, or practices.

Disclaimers and Limitations of Liability

"AS IS" Basis

MUZIM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Uninterrupted or error-free operation

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Loss of data, profits, revenue, or business opportunities

  • Service interruptions or data corruption

  • Any damages arising from your use or inability to use the App

Your sole remedy is to stop using the App.

Data Loss

While we implement security measures:

  • We are not responsible for data loss due to device failure, user error, or other causes

  • You are responsible for maintaining your own backups

  • We strongly recommend backing up your important data

User Responsibilities

You agree to:

  • Use MUZIM in compliance with all applicable laws

  • Respect the intellectual property rights of others

  • Maintain accurate and current information

  • Backup your important data regularly

  • Use reasonable security measures to protect your device and account

Updates and Modifications

App Updates

  • We may release updates, patches, or new versions

  • Updates may be required for continued use

  • We may discontinue or modify features at any time

Terms Updates

  • We reserve the right to modify these Terms at any time

  • Changes will be effective upon posting

  • Continued use after changes constitutes acceptance

  • We will provide notice of material changes through the App or email

Termination

Your Rights

You may stop using MUZIM at any time by:

  • Uninstalling the application

  • Revoking Google account access

  • Deleting your local data

Our Rights

We may suspend or terminate your access if:

  • You violate these Terms

  • Your use creates legal liability or security risks

  • Required by law or government request

Effect of Termination

Upon termination:

  • Your license to use MUZIM ends immediately

  • You must stop using the App

  • Your local data remains on your device (you may delete it)

  • These Terms continue to apply to past usage

Geographic Restrictions

MUZIM is intended for use worldwide, but we make no representation that the App is appropriate or available for use in all locations.
Users are responsible for compliance with local laws.

Dispute Resolution

Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.

Arbitration

Any disputes arising from these Terms or your use of MUZIM shall be resolved through binding arbitration, except where prohibited by law.

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

You agree to indemnify and hold harmless MUZIM, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MUZIM regarding use of the App, superseding any prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent.
We may assign these Terms without restriction.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including:

  • Natural disasters

  • War, terrorism, or civil unrest

  • Government actions or regulations

  • Internet or network failures

  • Third-party service disruptions (including Google services)

Special Terms for Google API Usage

MUZIM’s use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Specifically:

  • We only request access to data necessary for app functionality

  • We do not use Google user data for advertising purposes

  • We do not allow humans to read your data unless required for security, compliance, or with your consent

  • We do not transfer Google user data to third parties (except as necessary to provide the service)

Beta and Experimental Features

MUZIM may offer beta or experimental features:

  • These features are provided “as is” with no warranties

  • They may be unstable or incomplete

  • We may discontinue them at any time

  • Use at your own risk

Feedback and Suggestions

If you provide feedback or suggestions about MUZIM:

  • You grant us the right to use them without obligation or compensation

  • We may implement, modify, or disregard any feedback

  • You waive any intellectual property claims related to implemented feedback
